今のお答えの中で、国民的議論の動向を見ながらというお答えがありましたが、人権問題につきましては、これは世論がどうとかという問題も一面大事なこととは思いますけれども、むしろ世論をリードしていかなくてはいけない責任が立法にはあるかと考えております。
本来、人権が不当に侵害されているという状況があるのであれば、それを法の解釈あるいは立法によってきちんと救うというのが本来の責任であるというふうに思っておりますので、是非、今法務省のお答えの中で、関係機関と連携しながら真剣に検討するというお答えでしたので、是非また機会を見ましてその真剣な検討の進捗状況をお伺いしたいと思っております。

〔２〕人権擁護法案の個別的な問題点
（中略）
●差別禁止事由を拡充すべき
・人権擁護法案では、差別禁止事由として「人種、民族、信条、性別、社会的身分、門地、障害、疾病又は性的指向」を挙げているが、これだけでは既存の人権問題に十全に対応することができず、また比較法的に見ても十分とは言えない。
・ここに掲げられた差別禁止事由以外に、皮膚の色、性的自己認識（＝肉体的・生物学的な性にかかわらず、当人が自分の性を男女いずれと認識しているか）、婚姻上の地位（＝既婚か未婚か、法律婚か事実婚か、世帯主か否かなど）、家族構成（子どもの有無、親との同居など）、言語、民族的又は国民的出身、年齢、病原体の保持などを加えるべきである。
●性的指向の定義を明確にすべき
・法案第２条では「人権侵害」、「社会的身分」、「障害」、「疾病」、「人種等」の定義を明らかにしているが、これに加えて「性的指向」の定義も定めておくべきである。性的指向という用語は、日本の法令上これまで存在しなかったものであり、それゆえ定義が確定していない。法律成立後、定義の広狭によって混乱が生じることを避けるためにも、「性的指向」の内容を明確にしておくべきである。
