仮処分 (有斐閣・法律学小辞典第三版)
 
 仮差押えと並ぶ民事保全の一種。仮差押えの場合と同様に,仮処分命令手続と仮処分執行手続に分かれる。仮処分には,2種類が存在する。第1は,係争物に関する金銭以外の請求権に基づく強制執行を保全するための,係争物に関する仮処分である〔民保23(1)〕。第2は,争いがある権利関係について債権者に生じる著しい損害又は急迫の危険を避けるため,本案訴訟の確定まで仮の状態を定める,仮の地位を定める仮処分である〔民保23(2)〕。後者は,将来の強制執行を保全するためのものではなく,保全されるべき権利の種類についても,特別の限定がない。仮処分発令の要件としては,いずれについても被保全権利と保全の必要性の疎明が要求されるが〔民保13(2)〕,保全の必要性の内容は,第1の場合には,将来の強制執行が困難になるおそれであり,第2の場合には,現在債権者に損害又は危険が存在することである〔民保23(1)(2)〕。仮処分の審理及び命令の形式は,仮差押えの場合と同様であるが,仮の地位を定める仮処分に関しては,それが債務者に与える不利益を重視して,原則として口頭弁論又は債務者の立ち会う審尋の期日を経ることが要求されている〔民保23(4)〕。なお,仮処分解放金についても定めがある〔民保25〕。

 ある疾患の患者数が増える場合,患者の絶対数が増えているケースと,潜在していた患者がマスコミなどの影響で表面に現れるケースとがある。
 マスコミで大きな話題になったGID(性同一性障害)が後者の典型で,5年前までに阿部さんの元を訪れた患者は4人にすぎなかったが,最近5年間ではなんと500人を超えている。

When Renee Richards stepped on to court to play Virginia Wade at the 1977 US Open she was making her debut in the women's singles - 17 years after she, or rather he, had made his debut in the men's singles. In 1975, Richards had a sex-change operation and the Richard H. Raskind who competed at the 1960 US Open became Renee Richards, who, after a ruling by the New York State Superior Court, took part in the same tournament - but different singles - in 1977. One thing remained unaltered though - the American transsexual's tennis playing ability. Raskind lost his first-round match in straight sets, and so did Richards.

Call for papers

Currently speakers are being invited for the listed workshops. If you would like to contribute a comparative legal paper to one of the workshops, please contact the organisers, and send a brief digest, pointing out the workshop you would like to be in, the topic and the countries you would cover.
Please remember that there is only a limited number of slots for speakers.
So not all offers of papers will result in invitations.
In selecting offers, the Conference programme committee will choose the papers taking into account the criteria that the submitted paper has to have a comparative approach and has to cover as many countries as possible.
Oral presentations will be allowed from ten to fifteen minutes.
The presenting author is in charge of her/his travel and accomodation expenses but the registration fee will be waived.
Speakers who will contribute to the conference will be later required to submit full manuscripts for publication.
All offers must be sent to the Conference programme Committee at glbtlaw.committee@informagay.it


Registration and fee

The registration for the Political forum on Wednesday June 5 and the Opening plenary session (including the keynote speaker intervention) on Thursday June 6 in the morning is free.

Full registration includes: entry to all conference sessions, participation to the workshops, welcome cocktail on Wednesday in the evening, lunch and coffe breaks each day of conference, gala dinner on Friday in the evening.

Full rate: 300 Euro
Students rate: 150 Euro


In order to help to overcome administrative difficulties, it is possible to request a letter of formal invitation; the letter of formal invitation does not committ financially the organisers.
