女装で女性トイレに入った男性釈放 (朝日・栃木版 2002/10/31)
宇都宮地検は３０日までに、ＪＲ宇都宮駅の女性用トイレに女装して入ったとして、建造物侵入の疑いで現行犯逮捕された男性（４３）を処分保留で釈放した。地検は「痴漢行為の証拠はなく、わいせつ目的ではなかった」と判断したという。男性は、体と心の性が一致しない「性同一性障害」を主張し、逮捕を不当としていた。
男性は１８日夜、同駅内の女性用トイレに女装して入ったが、化粧をほとんどしないで男物のカバンを持っていたため、駅利用客が鉄道警察隊に連絡。男性は現行犯逮捕された。
調べに対し男性は、「２０歳のころから女装をしていた」「裁判でも自分が男だとは認めない」などと性同一性障害を主張。「女性用トイレに入るほかなかった」と訴えていたという。
女性が被害を受けておらず、男性が盗撮用機器なども持っていなかったため、地検は「わいせつ目的ではない」として男性を釈放した。今後は任意で捜査し、起訴するかどうか決めるという。

宇都宮 ４３歳の男を逮捕
女子トイレに正当な理由がなく侵入したとして、宇都宮東署は十八日、建造物侵入の現行犯で住所不定の無職男性（４３）を逮捕した。男性は、長髪のカツラ、黒のパンスト、ブーツなど女性用のものばかりを身に着けていた。
調べによると、男性は同日深夜、ＪＲ宇都宮駅の女子トイレに入ったが、ほかの利用女性に「変な人がいる」と通報された。男性は「用を足すためだけに入った。成人になったころから女性として生活しており、ずっと女子トイレを利用してきた」と供述しているという。
同署では、「悪気のあるなしの問題ではない。女装していればだれでも入っていいのかということになってしまう」と厳正な法適用を強調した。
性同一性障害の診断に携わっている岡山大医学部付属病院の佐藤俊樹医師は「このような事態を防ぐために診断書を携帯する人はいる。見た目で男性の人が、女子トイレに入ることに理解が得られるかは難しい問題だ」と話している。

１８日午後１０時３５分ごろ、宇都宮市のＪＲ宇都宮駅の女性用トイレに女装した男が入って来たのを、利用者が見つけて駅員に通報。栃木県警鉄道警察隊が建造物侵入の現行犯で逮捕した。
男は群馬県赤城村出身の住所不定、無職、(削除)容疑者（４３）。
同隊から身柄を引き継いだ宇都宮東署の調べに、(削除)容疑者は「長いこと女として生活している」と話しているという。
同容疑者は、黒のワンピースなどを着て長髪のかつらを着けていた。化粧はしていなかった。
女性トイレを使った女装男「私は女」 (朝日・栃木版 2002/10/20)
女装した男が女性用トイレに入り逮捕−−。こんな事件が１８日、ＪＲ宇都宮駅であった。男は以前から女装の習慣があり、のぞきなどのためではなく、用を足すために女性用トイレに入ったという。「私は女だ。何が悪い」「裁判になっても自分が男だとは認めない」などと話し、「不当逮捕」を主張しているという。
建造物侵入の疑いで宇都宮東署に現行犯逮捕されたのは、住所不定無職、(削除)容疑者（４３）＝本籍群馬県赤城村＝。
調べでは、(削除)容疑者は１８日午後１０時３５分ごろ、同駅の改札内にある女性用トイレに正当な理由なく侵入した疑い。「変な人がいる」と駅の利用客から連絡を受けた駅員が通報し、鉄道警察隊員がトイレから出てきた容疑者を取り押さえた。
容疑者は黒色のワンピースに茶色のロングブーツという姿で、長い黒髪のカツラをつけ、胸パッド入りのブラジャーをしていたという。ただし、顔はノーメークに近く、逮捕時に持っていたかばんも男性用のもので、正面から見ればすぐ男性だとわかったという。
容疑者は２０歳のころから女性の服を着ているといい、取り調べに対し、「この格好で男性トイレに行けば変に思われるだろう」「『正当な理由なく女性トイレに入った』という容疑はおかしい」などと話しているという。

「男性議員の中には、性転換を考えている人もいるそうだ」――。小泉純一郎首相は１７日夜、政府の男女共同参画会議メンバーとの会食で、先の内閣改造で女性閣僚４人をそろって留任させたことに関し、こう発言する一幕があった。
「女性だから閣僚に起用したわけじゃない。実力のある人を登用しているだけだ」と力説する中でのジョーク。ただ、自民党内の入閣待望組をやゆした内容だけに、反発を呼ぶ可能性もある。

男か、女か。大半の人は自分の性別に疑問を抱かずに生きている。性同一性障害と呼ばれる人たちは心と体の性の不一致に苦しんでいる。体への違和感を、ある人は「脱げないぬいぐるみを着せられているようだ」と表現する。
同性愛と混同されがちだった性同一性障害への理解がすすんだのは９８年、日本精神神経学会が定めたガイドラインに沿って埼玉医大で初の性別適合（性転換）手術が行われてからだ。同大と岡山大医学部で合わせて約７００人が手術を待っている。
体の性に心を押し込めようと苦悩していた人たちが、治療によって心が求める体を取り戻し、名前を変えて生きられるようになった。競艇の安藤千夏選手は安藤大将（ひろまさ）選手として再びデビューした。記者会見でのはればれとした表情が印象的だった。
しかし彼らの社会生活は安心からはほど遠い。パスポートなど公文書の性別がもとのままだからだ。性別適合手術を受けた６人が去年、各地の家裁に戸籍の性別訂正を申し立てた。このほど最初のひとりに対する判断が出たが、答えはノーだった。
申立人のひとりで当事者らのためのミニコミ「ＦＴＭ日本」を主宰する虎井まさ衛さん（３８）は男性として生きる。女性と記された住民票を勤務先に出せず、正社員になるチャンスを棒に振った。病気になっても保険証を使うのがいやで、売薬ですます。
東京で公開中の米映画「ロバート・イーズ」は、男性になったがん患者が治療を拒まれて死ぬまでの１年を追った。心の性でいるために、命をかけなければならない人もいる。

東京都小金井市議会は３０日、性同一性障害者について、戸籍の性別変更を認めるよう求める意見書案を全会一致で可決した。法務省によると、地方議会でこうした意見書案が可決されたのは珍しいという。
意見書は、最近多発している虚偽の婚姻届や養子縁組届による戸籍改ざん事件の防止などを求めたもので、現行の戸籍法には、虚偽届け出による記載を訂正しても、その跡が残ってしまうなど６項目の問題点があると指摘。その中の一つとして、「性同一性障害者の性別変更については性別の書き換えのできる道を開くこと」と要望している。
性転換者については９８年から、国内でも治療のための正式な手術が始まり、家庭裁判所に戸籍上の性別訂正の許可を求める動きも出ているが、ほとんど認められない状況だという。
