性同一性障害 「戸籍の性別訂正 実現働きかけを」
小金井でフォーラム (朝日・多摩版 2002/11/12)
「戸籍の性別訂正 地方自治体や当事者ができること」と題した公開フォーラムが小金井市で10日開かれた。
同市議会は9月30日、性同一性障害者の性別訂正を求める決議を可決している。
フォーラムでは、性別訂正を実現させるため各地の議会への働きかけを強めていくことなどが提案された。
当事者や研究者、地元の市長、市議ら約100人が参加した。
米国で女性から男性への性転換手術を受けた作家の虎井まさ衛さんが、当事者達は性別訂正が認められないため、就職や賃貸住宅の契約など、住民票や運転免許証などの提示を求められる場面で、多くの困難に直面していると報告。
「手術のアフターケアのために、米国へ行く必要があるが、パスポートにも性別が記載されており海外には行きづらい」と話した。
性別訂正をめぐっては、虎井さんら６人が昨年５月、各地の家庭裁判所に申し立てをしたが、１人が今年８月、許可を認めない決定を受けている。
こうした状況について、「性同一性障害と法」などの著書がある神戸学院大学法学部の大島俊之教授は「先進国で性別訂正をほとんど認めていないのは日本だけ。国内でも過去に家裁で訂正が認められた例があり、現行法でも障害はないはずなのに、依然として当事者の申し立てが許可されないのは疑問だ」と指摘した。
会場からは「税金も納め、普通に暮らしたいだけなのに国は助けてくれない」「当事者が行動に出ることで動くことは多いのではないか」といった意見が出された。
人権擁護法案、参院法務委で７日から実質審議 (朝日 2002/11/06)
メディア規制につながるなどと議論となった人権擁護法案をめぐる実質審議が７日、参院法務委員会で始まる。同法案は、先の通常国会に提出されたが、野党・市民団体が反対し、審議が止まっていた。政府・与党は法案を一部修正し、今国会で成立させたい意向だ。一方、野党は抜本的な修正を求めている。
７日は政府に対する質問があり、１２日に参考人質疑が行われる予定。
法案によると、５人の委員による人権救済機関「人権委員会」を法務省の外局に創設する。
救済対象には、報道機関の取材行為を含んでいるが、この部分が「メディア規制にあたる」と先の国会で批判された。今回、早期成立をめざす与党は、メディア規制部分を他の法律で解除するまで凍結する修正を図るほか、法全体を一定期間後に見直す条項を入れることで合意した。
一方、野党は実効性のある人権救済機関を創設するには、与党の修正案では不十分との立場。人権侵害が報告されている刑務所・入管施設などを所管する法務省の外局に人権委が創設されることなどを見直すべきだとしている。

通常国会から継続審議になっていた人権擁護法案の実質的な審議が７日の参院法務委員会で始まることが５日、決まった。法案は、メディアの「過剰な取材」や「プライバシー侵害」などを、新設する人権委員会の特別救済の対象にした点や、人権委を法務省の外局とした点などで与野党が対立し、実質審議に入っていなかった。今国会では、与党がメディア規制部分を凍結し、法案の見直し規定を盛り込むことで修正を図る方針を固めている。

男性器に障害（尿道下裂）がある子供の母親は、工業製品中の樹脂などに使われ、内分泌かく乱化学物質（環境ホルモン）として疑われているビスフェノールＡ（ＢＰＡ）の血中濃度が、一般の妊婦に比べて約２倍高いことが、横浜市立大学の平原史樹教授らの調査で明らかになった。また、一般の胎児のＢＰＡ濃度が、妊婦より約３倍高いことも確認され、ＢＰＡが胎児の体内で濃縮されている可能性が指摘された。
環境省の委託調査で、広島市内で開かれていた「内分泌かく乱化学物質問題に関する国際シンポジウム」で２８日、発表された。
調査は、障害のある子供の母親３０人と一般妊婦８２０人の血液を比較。その結果、ＢＰＡ濃度はそれぞれ１ミリ・リットル中に約０・８２ナノ（ナノは１０億分の１）グラム、約０・４０ナノ・グラムで、約２倍の濃度差があった。
一方、同じ一般妊婦（８２０人）の血中ＢＰＡ濃度（約０・４０ナノ・グラム）と、その胎児のさい帯血の濃度（約１・３７ナノ・グラム）を比べたところ、胎児は母親より約３倍高かった。
内分泌かく乱化学物質は、生体内でホルモンと似た作用をし、生殖器などの性分化や免疫の発達などに影響を与える可能性がある。ＢＰＡが直接障害を引き起こしたかどうかは未確認で、今後、原因を調べる。
共同研究した神奈川県立こども医療センターの黒木良和所長は「女性のＢＰＡ濃度は妊娠中とそれ以外の時期で違う可能性がある。調査を進めてＢＰＡと尿道下裂の関係を調べたい」と話している。

河南：性別転換後の戸籍の変更手続を具体化

『中新網』１９日付の報道によると、河南（かなん）省公安庁と衛生庁が公民の性転換手術後の戸籍上性別項目変更手続について具体的な規定を制定した。
規定によると、性転換手術後に戸籍上の性別項目の変更を希望する場合、市（他の省を含めて）レベル以上の病院による性別変換手術が成功した証明書を提出し、県または市の公安機関の審査を受けた上、公安派出所に性別項目変更手続をしてもらわなければならない。国外もしくは国内の県（他の省を含めて）レベル以下の病院で手術を受けた場合、各省または直轄市の衛生行政部門が指定した病院による性別認定証明書を提出し、県または市の公安機関の審査を受けた上、公安派出所に同手続をしてもらう。
手続が完了すれば、新たな身分証番号が発行され、「常住人口登記表」の裏にある登録事項変更欄に変更内容が記載される。すでに住民証を持っている場合、公安機関が古い身分証を回収した上、新しい住民証を発行する。
今日、性別転換は中国大陸ではそれほど珍しいことではなくなりつつある。『上海労働報』は中国大陸において性別転換を希望する患者はおよそ４０万人に近くで、多くの人が願いを実現できたと報じている。有名な整形外科専門家である何清濂教授は性転換手術後に結婚して正常な生活を送った患者のことを事例に、中国社会がすでに性転換者を寛容に受け入れられるようになったと指摘した。
