自由権規約17条にいうプライバシー権に関して、オーストラリアのタスマニア州において、成人の同意による同性愛行為を禁止する州刑法が存続していることが、申立人（同性愛者の権利運動の活動家）のプライバシーに直接干渉していると認定された事件。自由権規約委員会は、道徳問題は排他的な国内事項であるとのタスマニア州の主張を退け、本件プライバシー侵害は、国内法上は合法であるにしても、17条違反に該当する「恣意的」なものであると結論づけた。

Japan has been recommended by the Human Rights Committee to ratify the above Optional Protocol.
下記「最終見解」33節に、「委員会は、締約国が人権侵害の被害者を救済するための措置をとること、特に、規約の選択議定書を批准することを勧告する。 」とある。
Paragraph 33 of the following "Concluding observations" reads "The Committee recommends that the State party take measures to provide remedies to victims of violations of human rights and, in particular, that it ratify the Optional Protocol to the Covenant."

7. 委員会は、人権の保障と人権の基準は世論調査によって決定されないことを強調する。規約に基づく義務に違反し得る締約国の態度を正当化するために世論の統計を繰り返し使用することは懸念される。
7. The Committee stresses that protection of human rights and human rights standards are not determined by popularity polls. It is concerned by the repeated use of popularity statistics to justify attitudes of the State party that may violate its obligations under the Covenant.
8. 委員会は、「公共の福祉」に基づき規約上の権利に付し得る制限に対する懸念を再度表明する。この概念は、曖昧、無制限で、規約上可能な範囲を超えた制限を可能とし得る。前回の見解に引き続いて、委員会は、再度、締約国に対し、国内法を規約に合致させるよう強く勧告する。
8. The Committee reiterates its concern about the restrictions which can be placed on the rights guaranteed in the Covenant on the grounds of "public welfare", a concept which is vague and open-ended and which may permit restrictions exceeding those permissible under the Covenant. Following upon its previous observations, the Committee once again strongly recommends to the State party to bring its internal law into conformity with the Covenant.
